Marriage, separation, support and children. These matters are decided in the Family Court, and they turn as much on documents — income, expenses, what was agreed — as on what is said in the hearing.
The matters handled
- Maintenance
- For a spouse, for children who are minors, and for parents and senior citizens entitled to be supported.
- Judicial separation
- Where the marriage is not to be dissolved but the parties are to live separately, with rights and obligations settled.
- Mutual divorce
- Where both spouses agree. Two motions, and the terms settled before filing rather than after.
- Child custody
- Who the child lives with, decided on what is in the child’s interest rather than on either parent’s claim.
- Child visitation
- Access for the parent the child does not live with — including enforcing an order that is not being honoured.
- Contested divorce
- Divorce on a ground under the Hindu Marriage Act where the other spouse does not agree.
Acting for either side
This practice appears for either side — the spouse applying and the spouse responding, the parent seeking custody and the parent resisting it. A maintenance claim and a defence to one are the same exercise seen from opposite ends: proving what is genuinely earned, needed and owed.
How long it takes
A mutual divorce is measured in months and turns on the six-month interval, which can sometimes be waived. A contested matter takes considerably longer. Interim maintenance can be ordered while a case runs.
