After a death in the family: legal heir certificate, patta transfer, and when it becomes a partition case
In short
Most families need, in order: a legal heir certificate from the Tahsildar, applied for through TN e-Sevai; the patta transferred to the heirs; and, for bank deposits or shares, sometimes a succession certificate from the civil court. None of these decides who owns what. If the heirs disagree about shares, it has become a partition matter.
The short version
- The legal heir certificate is issued by the Tahsildar and is a record of relationship, not a decision on shares.
- A succession certificate is a different document, granted by the civil court for the deceased’s debts and securities.
- A patta in one heir’s name does not cut out the others.
- Probate in Chennai stopped being mandatory when s.213 of the Indian Succession Act was omitted in December 2025.
What are the steps, in order?#
- Legal heir certificate. Apply on TN e-Sevai (service REV-114) with the death certificate and relationship proof for every heir. The Madras High Court calls it a “relationship certificate”, not a decision on shares.
- Succession certificate, if asked for. This one is granted by the District Judge on a petition under s.372 of the Indian Succession Act, 1925, and covers debts and securities such as deposits and shares.
- Patta transfer. Apply to the Taluk office with the death certificate, legal heir certificate and existing patta.
- Agreement among the heirs. If one heir is to hold the land, the others usually execute a registered release deed; a signed “consent” note is a poor substitute.
Until December 2025 a Hindu will made in Chennai had to be probated before anyone could claim under it. The Repealing and Amending Act, 2025 omitted s.213 of the Indian Succession Act, so probate is no longer mandatory.
Does a patta in my name make the property mine?#
No. The Supreme Court has said a mutation entry “does not confer any right, title or interest”. The other heirs’ shares come from succession law.
When does it become a partition case?#
- An heir will not sign a release deed or agree on shares.
- One heir has sold, mortgaged or let the property as if it were entirely theirs.
- The patta was moved into one name without the others knowing.
Then the shares are decided by a civil court, in a partition suit.
What should you do this week?#
- Collect the death certificate, relationship proof for every heir, the patta and the parent deeds.
- Apply for the legal heir certificate.
- Talk to the other heirs before anyone applies for patta transfer.
