| Provision | Law | What it means for you |
| --- | --- | --- |
| Order XX Rule 18, CPC | The two decrees | A partition is decided twice. A preliminary decree declares each person’s share; a final decree divides the property on the ground. Nothing is physically divided by the first one. |
| Order XXVI Rules 13–14, CPC | The Commissioner | After the preliminary decree the court appoints a Commissioner to measure and divide by metes and bounds, and to award money to equalise unequal shares. The parties may object to the report before it is confirmed. |
| Section 97, CPC | Appeal the preliminary decree, or lose the point | A party who does not appeal the preliminary decree is barred from disputing it later in an appeal from the final decree. Shares must be fought at the first stage, not the second. |
| Section 37, TN Court-Fees and Suits Valuation Act 1955 | The fee fork | A plaintiff in joint possession pays a fixed fee. A plaintiff excluded from possession pays on the market value of their share. A defendant claiming partition in the written statement pays half either way. |
| Section 6, Hindu Succession Act 1956 | Daughters as coparceners | A daughter is a coparcener by birth, on the same footing as a son. Confirmed by the Supreme Court in Vineeta Sharma v. Rakesh Sharma (2020). |

Where the property is, and what the claim is worth, decide the court. In Chennai a suit is filed before the Assistant Judge of the City Civil Court up to ten lakh rupees, before the Principal or an Additional Judge of the City Civil Court above that and up to one crore, and on the original side of the Madras High Court above one crore. That ceiling was raised from twenty-five lakh to one crore with effect from 1 February 2019 — most material still online gives the old figure. Outside the city the ladder is the District Munsif, the Sub-Court and the District Court. Where the land is an estate paying revenue to Government, the court declares the shares but the Collector carries out the division.

Commonly believedWe divided the property orally years ago, so there is nothing left to partition.

In factThe Supreme Court in *Vineeta Sharma* (2020) held that a plea of oral partition **cannot ordinarily be accepted**, and one resting on oral evidence alone is to be rejected outright. What counts is a **registered partition deed** or a decree of court, with a narrow exception where public documents corroborate the division.

Commonly believedMy sister married before 2005, so she has no share.

In factA daughter is a coparcener **by birth**, whether born before or after the 2005 amendment, and **it does not matter whether the father was alive on 9 September 2005**. Marriage is irrelevant. A daughter can be brought in even after a preliminary decree, in the final decree proceedings or on appeal.

Commonly believedThe preliminary decree means the case is over.

In factIt only declares the shares. The property is divided in the **final decree proceedings**, through a Commissioner who measures, allots and reports. The opposite trap matters more: if you do not **appeal the preliminary decree**, you cannot dispute those shares later.

Commonly believedPartition suits carry a small fixed court fee in Tamil Nadu.

In factOnly if you are **in joint possession**. If you have been excluded, the fee is on the **market value of your share**, which on a Chennai property is a different order of magnitude. And if you also want a settlement or sale deed cancelled, a **separate fee** is payable on that relief — a partition plaint cannot shelter the cancellation under the fixed rate.

Commonly believedMy name is on the patta, so the property is mine.

In factA patta is a **revenue record, not a document of title** — the Madras High Court has said so directly, and the Supreme Court has held that a mutation entry confers no right, title or interest and exists for fiscal purposes. Title comes from the registered deeds. The reverse is also true: having no patta does not defeat a title you otherwise hold.
